Foreigners cannot directly own freehold land (Hak Milik) in Indonesia. The safest and most legal route for foreign investors is to establish a PT PMA (Perseroan Terbatas Penanaman Modal Asing). Through the PMA, you can acquire the Right to Build (Hak Guna Bangunan - HGB) or Right to Use (Hak Pakai).
Once the PMA is established with the required capital, the company can legally purchase the land. This structure offers full legal protection and allows you to develop, operate, or sell the property securely, avoiding the severe risks associated with nominee agreements.
